EPFO Recovers ₹61 Crore Dues from SpiceJet: A Closer Look

The Employees’ Provident Fund Organisation (EPFO) has recently made headlines by recovering ₹61 crore in provident fund dues from SpiceJet, a prominent player in India’s aviation industry.

This development sheds light on the financial health of the airline and its commitment to meeting its obligations toward employees.

EPFO vs. SpiceJet: Background

SpiceJet, like many other airlines, faced significant challenges during the pandemic-induced downturn in the aviation sector.

The company’s financial woes led to scrutiny of its compliance with employee-related statutory requirements, including provident fund contributions.

The EPFO stepped in to assess and recover outstanding dues, emphasizing the importance of timely payments for the welfare of employees.

Key Highlights

  1. Partial Recovery: The EPFO has successfully recovered ₹61 crore from SpiceJet for the period spanning March 2020 to May 2021. However, it’s essential to consider that approximately 7,398 employees were lost due to the divestment of the firm, State Street. Excluding this effect, the headcount remained relatively flat quarter-on-quarter.
  2. Remaining Assessment: The EPFO is currently assessing the dues for the period after January 2022. This assessment includes not only the outstanding principal but also penal damages and interest on late payments.
  3. Cooperation with a Time Lag: SpiceJet acknowledges that there has been a delay in some deposits. Despite this, the airline affirms that clearing dues remains a top priority. The company is cooperating with the EPFO in the recovery process.
  4. Section 14B Inquiry: The EPFO has initiated an inquiry under Section 14B of the Employees’ Provident Fund & Miscellaneous Provisions Act, 1952. This section allows for the levy of penal damages and recovery of interest for delayed payments.
  5. Ongoing Assessment: The process of assessment and recovery for the remaining period (up to the present) is underway under Section 7A of the Act. SpiceJet’s compliance during this phase will be crucial to avoid further penalties.

SpiceJet, while acknowledging a lag in some deposits, denies the EPFO’s claim of partial recovery.  SpiceJet refuted the EPFO’s claim of partial recovery, asserting, “All PF dues for the mentioned period have already been deposited.”

The airline also clarified that it has cleared part of the PF dues for the period post-January 2022.

A senior government official familiar with the matter stated, “Notwithstanding the time lag, the retirement fund body has initiated an inquiry for penal damages and recovery of interest for the delayed payments.”
